EULA - End User License Agreement

LICENSE AGREEMENT FOR THE CHARDIFF TRIAL VERSION

Please read the regulations of this license agreement carefully before you install the software or pass it on to a third party.

Through installation, use, copying or passing on of this program you declare your consent with the license agreement. If you do not agree with any regulation of this license agreement, you may neither install, use, copy, nor pass the CharDiff trial version on to somebody else.

Per acceptance of this license agreement for the CharDiff trial version (henceforth called CharDiff), a contract is placed between you as the licensee and Tillmann Wegst (henceforth called TW) as the licenser.
I. DURATION OF THE LICENSE
You are allowed to use CharDiff during an evaluation period of three weeks (21 days) free of charge.

If you want to use CharDiff upon expiration of the evaluation period, you must purchase a CharDiff license.

II. COPYRIGHT
CharDiff is protected by copyright.
The use of the CharDiff trial version after the three weeks evaluation period is a violation of the copyright of TW.
III. COPIES
You may create copies of the CharDiff installation program for personal backup purposes.
IV. TRANSFER
You are allowed to pass the CharDiff installation program on to other persons, provided that

1. no modifications have been made to the installation program, nor to the name of the installation program,
2. there are no indications nourishing the assumption that the receiver/s will violate the license agreement, and
3. the transfer does not serve to extend the evaluation period of you or another person.

It is expressly prohibited,

1. to instead of the installation program pass on the executable or other parts of CharDiff unpacked during installation,
2. to lend or rent out CharDiff for a fee, donation, or another form of compensation,
3. to offer CharDiff for download on a website,
4. to offer CharDiff bundled with another program or system. This applies also if the offer is made free of charge.
V. PROGRAM INTEGRITY
You are not allowed to modify CharDiff, to decompile it, to analyse it, to deconstruct it, to translate it or use it for the creation of your own software.
VI. DISCLAIMER OF WARRANTY
CharDiff has been carefully designed and implemented; still, bugs cannot be completely ruled out.

TW strives to remove bugs and defects as soon as they become known; however, he exludes all claims for rectification of defects or the liability for damages which might result directly or indirectly from the use of the program.

TW forbids expressly the application of CharDiff in contexts where malfunctions of the program might result in injuries of life, body, or health of persons or penguins. All uses of the program are at the users own risk.

You commit yourself to keep TW free from all claims for damages from your side or the side of third parties, including all court and lawyer fees, which might arise to TW from your use of the program.

TW will not be liable for any loss, including lost profit.

TW recommends strongly to test CharDiff, just like any other software, extensively in a non-critical environment prior to its productive use. It is completely at your own risk that the program serves the purposes you intend it to.
VII. VIRUS PROTECTION
The installation program as well as the executable unpacked during installation have been tested by TW prior to delivery for freedom from viruses, worms, trojans, and other varmints, using an up-to-date virus scanner.

No anti-virus program can offer perfect safety, however. Also, the delivery of the program over the internet carries some risk of infection. Therefore, TW does not guarantee for freedom from viruses.

The user is recommended to examine both the installation program and the program unpacked during installation with a virus scanner enjoying his confidence.
VIII. LEGAL RESERVATION
All rights concerning CharDiff which this agreement has not expressly assigned to the licensee, remain with TW.
IX. LEGAL VENUE
This license agreement is exclusively subject to German law.
The competent authority for disputes regarding this agreements is the Landgericht Saarbrücken.
